Am I required to show up?

Yes. If you got a summons, you show up. Not showing up can lead to a bring-in warrant — the police come to your house or your job and take you. You don't want that.

Can I be detained on the first day?

Yes, they can hold you up to 24 hours without an arrest warrant. After that, the prosecutor asks the judge for preventive arrest — which can last 30 days, renewable. But if you're not a public danger and have a stable address, the odds drop.

What happens if I say nothing?

Nothing. It's your constitutional right. Silence cannot be interpreted as admission of guilt. The prosecutor has to prove it, not you. Shut up and let the lawyer do the talking.

Art. 118 — Dreptul martorului la tăcere și neautoincriminare

(1) Martorul are dreptul să nu declare fapte și împrejurări de fapt care, dacă ar fi cunoscute, l-ar incrimina. Organul judiciar este obligat să îi aducă la cunoștință acest drept înainte de fiecare audiere, în condițiile art. 120.

(2) Probele obținute cu încălcarea prevederilor alin. (1) nu pot fi folosite împotriva martorului în niciun proces penal. Dispozițiile art. 102 alin. (3) și (4) se aplică în mod corespunzător.

(3) Declarația de martor dată de o persoană care, în aceeași cauză, anterior declarației a avut sau, ulterior, a dobândit calitatea de suspect ori inculpat nu poate fi folosită împotriva sa. Organele judiciare au obligația să menționeze, cu ocazia consemnării declarației, calitatea procesuală anterioară.

(4) Dacă martorul se prezintă la audiere însoțit de un avocat, acesta poate asista la audiere.

How much does a good criminal lawyer cost?

Between 2,000 and 15,000+ EUR for a DIICOT case, depends on complexity. A fee of 3,000–5,000 EUR is realistic for an experienced lawyer. Sounds like a lot? Compare it with the alternative. A court-appointed lawyer is free, but usually overwhelmed by the caseload.

What's the difference between suspect and defendant?

Suspect — there are indications you committed a crime, but criminal action hasn't been initiated yet. Defendant — criminal action has been initiated, you have additional rights but also a more serious situation. In both cases: lawyer, silence, zero statements.

Can I leave the country?

Depends. If you have judicial control or house arrest, no — you've been explicitly forbidden. If you have no preventive measure, technically you can leave. But if you have an active case and disappear, they'll issue a European arrest warrant. Think twice.

How long does a DIICOT case last?

Between 1 and 5+ years. The criminal investigation phase can take years. Then it reaches the court, where more months or years pile up. The system is slow — and that, most of the time, works in your favor. Use the time.

What is judicial control?

A preventive measure softer than arrest. You report periodically to police, you can't contact certain people, you can't leave your city or the country without approval. It can be challenged. It's better than arrest, obviously.

Can I refuse a search?

If they have a warrant from the judge — no. They're coming in regardless. If they don't have a warrant, they can only search with your written consent. Don't sign anything. No warrant, no search. But if they come with the warrant, stay calm, don't obstruct, and film if you can.

Is it worth snitching for a reduced sentence?

On paper, yes — you get up to half off your sentence. In practice, you become a permanent informant. You rat on one guy, tomorrow they call you for another. And in the circles you run in, if word gets out that you snitched, you've got bigger problems than the case. Talk to your lawyer before making any decision.

Can I delete messages and data from my phone?

If you already have a case, destroying evidence is a separate crime. If you don't have a case — it's your phone, do what you want. But anyway, the messages the informant already showed are already in the file. You can't delete what exists on someone else's phone.

I only got a phone call, not a summons. Do I go?

A phone call is not an official summons. The summons comes on paper or electronically through the courts portal. If someone calls you "from DIICOT" and tells you to show up at the DIICOT headquarters, then it's legit.
